1. INTELLECTUAL PROPERTY RIGHTS

All content on this site, including but not limited to photographs, images, designs, text, graphics, and software, is the exclusive property of Amichi Co and is protected by copyright, trademark, and other intellectual property laws. Users are not permitted to copy, reproduce, distribute, or otherwise use any of Amichi Co’s intellectual property without prior written consent. Unauthorised use may result in legal action.

2. LIMITED LICENSE FOR PERSONAL USE ONLY

By purchasing a print from Amichi Co, you are granted a limited license to use the artwork for personal, non-commercial purposes only. This license prohibits the resale, reproduction, or public display of the print in any commercial setting without prior written approval from Amichi Co. Unauthorised commercial use or display may result in termination of the license and legal action.

3. RESTRICTIONS ON ALTERATIONS AND RESALE

Ownership of a physical print does not imply ownership of the copyright or the right to reproduce, alter, or resell the artwork. Amichi Co retains all copyright and reproduction rights to its images. Alteration of any print or framing materials provided by Amichi Co is prohibited without prior consent.

4. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including copyright laws). A breach or violation of any of the Terms will result in immediate termination of your Services.

5. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and adaptations to meet technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission from us.

We reserve the right to refuse any order you place with us. In our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we may attempt to notify you via email or billing contact information.

10. US CUSTOMERS

This section includes terms specific to customers in the United States. All orders placed by US customers are subject to applicable US laws, including federal and state-specific consumer protection laws. By purchasing from Amichi Co, you acknowledge and agree to comply with all applicable US laws and regulations.

10.1 Sales Tax

US customers may be required to pay state-specific sales tax, depending on their location. Sales tax is calculated at checkout and will be shown on your order summary.

10.2 Shipping and Delivery

Orders placed by US customers will be shipped in accordance with the shipping policy provided at checkout. Amichi Co is not liable for any delays caused by the carrier or due to customs regulations for international shipments.

10.3 Dispute Resolution for US Customers

If a dispute arises, it will be governed by the laws of the State of New York unless otherwise specified. US customers may have additional rights under state laws.

12. CUSTOMS AND IMPORT TAXES

For orders shipped outside of Australia and the United States, you may be subject to import taxes, customs duties, and fees levied by the destination country. Any additional charges for customs clearance are your responsibility. Amichi Co has no control over these charges and cannot predict what they may be. Customs policies vary widely, so you should contact your local customs office for more information. Amichi Co is not responsible for delays due to customs.

We may provide access to third-party tools over which we neither monitor nor have control nor input. You agree to use these tools at your own risk. You agree to indemnify, defend, and hold harmless Amichi Co, its affiliates, officers, agents, and employees, from any claim or demand, including reasonable attorneys’ fees, arising from your breach of these Terms of Service or applicable laws.

20. INSTALLATION AND CARE RESPONSIBILITIES

Amichi Co provides recommendations for installation and care of our prints. However, the customer assumes full responsibility for any damage resulting from improper handling, display, or installation of the artwork. Amichi Co is not liable for damage incurred after the print leaves our facility, including damage related to transportation, installation, or environmental factors.

21. RETURNS AND REFUNDS FOR FINE ART PURCHASES

We take great pride in providing products of high quality and lasting value. All Amichi Co prints are made to order, meticulously handcrafted, and custom-framed specifically for each customer. While we hope you are fully satisfied with your purchase, we offer a 14-day peace of mind policy that allows you to return or exchange your item under specific conditions. Please note that personalized items, final sale items, and items purchased with a discount or during a promotion are not eligible for return or exchange.

22. DISPUTE RESOLUTION AND ARBITRATION

For any disputes arising out of or relating to these Terms of Service or the purchase of our products, you agree to attempt to resolve the dispute informally by contacting Amichi Co first. If we are unable to reach a resolution, any dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (for US customers) or equivalent local arbitration rules (for customers outside the US). Arbitration will occur on an individual basis, and you waive any right to bring claims as a plaintiff or member in any purported class or representative action.

23. LOSS OR DAMAGE DURING TRANSIT

Amichi Co is not responsible for loss or damage of products during transit. Once your order has left our facility, it is under the care of the shipping carrier. In the event of a lost or damaged item, please contact the shipping carrier directly with your tracking information for resolution. For additional assistance, you may reach out to our customer service team.

24. FORCE MAJEURE

Amichi Co shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, government orders, or failures in telecommunications or internet services. In the event of such a delay or failure, Amichi Co may, at its discretion, terminate any pending orders and offer a refund or extend delivery times.

25. THIRD-PARTY SERVICES AND FRAMING

Amichi Co does not accept responsibility for any damage, alteration, or quality issues arising from third-party framing, mounting, or customisation services. All products should be inspected upon receipt, and any customisation performed by a third party is at the customer's own risk.

26. CONSUMER RIGHTS

Nothing in these Terms of Service is intended to exclude any rights you may have as a consumer under applicable local laws. Consumers may have additional rights under their local consumer protection laws, which shall apply in addition to these Terms.

27. GOVERNING LAW

For Australian customers, these Terms of Service shall be governed by the laws of Australia. For US customers, New York state law will apply unless otherwise specified. Customers are responsible for compliance with local laws.

28. CHANGES TO TERMS OF SERVICE

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check periodically for changes.

29. DISCOUNTS & PROMOTIONS

From time to time, Amichi Co may offer discounts, promotions, and special codes to enhance your shopping experience. By using these discounts or promotional codes, you agree to the following terms:

  • General Terms: Discounts and promotions are subject to specific terms and conditions provided at the time of promotion, and each offer may vary. Amichi Co reserves the right to modify or withdraw any promotional offer at its discretion and without prior notice.

  • One-Time Use: Unless otherwise specified, discount codes are valid for single use per customer and are non-transferable.

  • Expiration: All promotional codes and discounts have an expiration date. Codes cannot be used beyond this date unless Amichi Co specifies otherwise.

  • Non-Transferable: Discounts and promotional codes are non-transferable and cannot be exchanged for cash.

  • Limitations on Use: Some discounts may be restricted to specific products, collections, or minimum order amounts, or may exclude certain items such as custom or sale items. The specific terms will be indicated with each promotion.

  • Final Sale Items: Items purchased with discount codes, during promotional periods, or as part of a sale may be considered final sale and ineligible for return or exchange, unless otherwise specified in the promotion terms.

  • Combining Discounts: Only one discount code or promotion may be applied per order. Discounts cannot be combined with other discounts, offers, or special promotions unless explicitly stated.

  • Order Adjustments: Once an order with a discount or promotional code is placed, codes cannot be applied retroactively or adjusted on an existing order. Any changes or cancellations to orders with discounts may forfeit the discount.

  • Limitations and Abuse: Amichi Co reserves the right to cancel or refuse any orders using a discount or promotional code if misuse, fraud, or a violation of the terms is suspected. Abuse of discounts or promotional codes may result in order cancellation and restriction from future use.

  • Assistance: If you have questions or encounter issues with a discount or promotional code, please contact our Support Crew at hello@amichico.com before completing your order, as we cannot retroactively apply discounts after an order is placed.

  • Promotional/Sale Gift Cards: Promotional gift cards (including those purchased at a discounted rate or as part of a special offer) cannot be redeemed toward purchases made during the same promotional or sale period. Customers may not combine the use of promotional gift cards with any other active promotion or discount running at the time of redemption. Promotional gift cards can only be used once the promotional period during which they were purchased has ended. There is also a limit to 2 per customer.
