This website is operated by Amichi Co. Throughout the site, the terms “Amichi”, “we”, “us”, and “our” refer to Amichi Co. Amichi Co offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including but not limited to browsers, vendors, customers, merchants, and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

1. INTELLECTUAL PROPERTY RIGHTS

All content on this site, including but not limited to photographs, images, designs, text, graphics, and software, is the exclusive property of Amichi Co and is protected by copyright, trademark, and other intellectual property laws. Users are not permitted to copy, reproduce, distribute, or otherwise use any of Amichi Co’s intellectual property without prior written consent. Unauthorised use may result in legal action.

2. LIMITED LICENCE FOR PERSONAL USE

When you purchase an Amichi Co fine art print, you are granted a limited licence to enjoy the artwork for personal, non-commercial purposes. Without our prior written approval, this licence does not permit the resale or reproduction of the print, or its public display in a commercial setting, except as set out below for approved trade and wholesale partners. Unauthorised commercial use or display may result in termination of the licence and legal action.

Trade and wholesale partners: businesses approved through our Trade & Wholesale programme may display Amichi Co artwork in the residential, hospitality and commercial interiors they source it for, and approved wholesale partners may resell it, in each case on the terms of their written trade or wholesale agreement. Trade and wholesale approval never includes the right to reproduce, copy or alter the artwork.

3. RESTRICTIONS ON ALTERATIONS AND RESALE

Ownership of a physical print does not imply ownership of the copyright or the right to reproduce, alter, or resell the artwork, except as allowed for approved wholesale partners in section 2. Amichi Co retains all copyright and reproduction rights to its images. Alteration of any print or framing materials provided by Amichi Co is prohibited without prior consent.

4. ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence or that you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorised purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including copyright laws). A breach or violation of any of the Terms will result in immediate termination of your Services.

5. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and adaptations to meet technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any content on the website through which the service is provided, without express written permission from us.

6. ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete, or timely sources of information. Reliance on the material on this site is at your own risk.

7. MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part of it) without notice at any time. We are not liable for any modification, price change, suspension, or discontinuation of the Service.

8. PRODUCTS OR SERVICES

Certain products or services may be available exclusively online. These products may have limited quantities and are subject to return or exchange only according to our Refund Policy.

We reserve the right to limit sales to any person, geographic region, or jurisdiction on a case-by-case basis. We may also limit quantities of products or services and discontinue any product at any time.

9. ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. In our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we may attempt to notify you via email or billing contact information.

10. US CUSTOMERS

This section includes terms specific to customers in the United States. All orders placed by US customers are subject to applicable US laws, including federal and state-specific consumer protection laws. By purchasing from Amichi Co, you acknowledge and agree to comply with all applicable US laws and regulations.

10.1 Sales Tax

US customers may be required to pay state-specific sales tax, depending on their location. Sales tax is calculated at checkout and will be shown on your order summary.

10.2 Shipping and Delivery

Orders placed by US customers are printed, framed and shipped within the United States, in accordance with our Shipping Policy. Amichi Co is not liable for any delays caused by the carrier.

10.3 Dispute Resolution for US Customers

If a dispute arises, it will be governed by the laws of the State of New York unless otherwise specified. US customers may have additional rights under state laws.

11. COPYRIGHT COMPLAINTS (DMCA NOTICES)

If you believe that any content on our site infringes your copyright, please email hello@amichico.com with:

a physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
identification of the copyrighted work claimed to have been infringed;
identification of the material claimed to be infringing, with enough detail (such as the page address) for us to find it;
your name, postal address, telephone number and email address;
a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law; and
a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.

12. CUSTOMS AND IMPORT TAXES

For orders shipped outside of Australia and the United States, you may be subject to import taxes, customs duties, and fees levied by the destination country. Any additional charges for customs clearance are your responsibility. Amichi Co has no control over these charges and cannot predict what they may be. Customs policies vary widely, so you should contact your local customs office for more information. Amichi Co is not responsible for delays due to customs.

13. OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide access to third-party tools over which we neither monitor nor have control nor input. You agree to use these tools at your own risk. Additionally, this website may contain links to third-party sites that are not affiliated with us. We hold no responsibility for the content or accuracy of third-party materials or websites.

14. USER COMMENTS, FEEDBACK, AND OTHER SUBMISSIONS

If you send creative ideas, suggestions, proposals, or other materials to us, you agree that we may use them without restriction. You agree that your comments will not violate any rights of any third party.

15. PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy, accessible here.

16. ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site that contains errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors or cancel orders if any information is inaccurate at any time. If we cancel an order you have already paid for, we will refund you in full.

17. PROHIBITED USES

You are prohibited from using the site or its content for unlawful purposes, to solicit others for unlawful acts, to violate laws or regulations, to infringe upon intellectual property rights, or any activity that could harm or defraud Amichi Co or its users.

18. WARRANTIES AND LIMITATION OF LIABILITY

Our products come with guarantees that cannot be excluded under the Australian Consumer Law, and customers outside Australia may have similar rights under their local laws (see section 26 and our Refund Policy). Nothing in these Terms excludes, restricts or modifies those rights.

Subject to those rights, we do not guarantee that the website will be uninterrupted or error-free and, to the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the website.

19. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Amichi Co, its affiliates, officers, agents, and employees, from any claim or demand, including reasonable legal costs, arising from your breach of these Terms of Service or applicable laws.

20. INSTALLATION AND CARE RESPONSIBILITIES

Amichi Co provides recommendations for installation and care of our prints. However, the customer assumes full responsibility for any damage resulting from improper handling, display, or installation of the artwork. Amichi Co is not liable for damage incurred after delivery, including damage related to installation or environmental factors.

21. RETURNS AND REFUNDS FOR FINE ART PURCHASES

We take great pride in providing products of high quality and lasting value. All Amichi Co prints are made to order, meticulously handcrafted, and custom-framed specifically for each customer.

Australian orders: within 14 days of delivery, you may return an artwork for a change of mind in exchange for store credit, less a 5% restocking fee, with return postage at your cost. This applies to full-price orders and orders using the Amichi Circle welcome offer. Items purchased during a sale event, with a limited-time promotional code or through the print set offer, custom or personalised items, and gift cards cannot be returned for a change of mind.

Orders delivered in the United States: each artwork is made to order especially for you by our specialist fine art print partner in the United States, so we are unable to accept returns or exchanges for a change of mind.

None of this affects your rights if an item is faulty, damaged or not as described. For full details, including how to start a return, please review our Refund Policy.

22. DISPUTE RESOLUTION

For any dispute arising out of or relating to these Terms of Service or the purchase of our products, please contact Amichi Co first at hello@amichico.com so we can try to resolve it informally.

Australian customers: nothing in these Terms limits your right to seek help from NSW Fair Trading or your local consumer protection agency, or to take a claim to a tribunal or court.

US customers: if we are unable to reach a resolution, any dispute shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will occur on an individual basis, and you waive any right to bring claims as a plaintiff or member in any purported class or representative action.

23. LOSS OR DAMAGE DURING TRANSIT

If your order arrives damaged or goes missing in transit, contact us at hello@amichico.com within 24 hours of delivery (or as soon as you notice a parcel is late) with your order number and photos of the packaging and artwork. We’ll deal with the carrier and arrange a repair or replacement where the damage happened in transit.

24. FORCE MAJEURE

Amichi Co shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labour disputes, government orders, or failures in telecommunications or internet services. In the event of such a delay or failure, Amichi Co may cancel any affected orders and refund you in full, or agree a new delivery time with you.

25. THIRD-PARTY SERVICES AND FRAMING

Amichi Co does not accept responsibility for any damage, alteration, or quality issues arising from third-party framing, mounting, or customisation services. All products should be inspected upon receipt, and any customisation performed by a third party is at the customer's own risk.

26. CONSUMER RIGHTS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms of Service excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other consumer protection law that cannot be excluded. Customers outside Australia may have additional rights under their local consumer protection laws, which apply in addition to these Terms.

27. GOVERNING LAW

For Australian customers, these Terms of Service shall be governed by the laws of New South Wales, Australia. For US customers, New York state law will apply unless otherwise specified. Customers are responsible for compliance with local laws.

28. CHANGES TO TERMS OF SERVICE

We reserve the right to update, change, or replace any part of these Terms of Service by posting updates on our website. Changes apply to orders placed after the updated Terms are posted; the Terms in place when you placed your order apply to that order. It is your responsibility to check periodically for changes.

29. DISCOUNTS & PROMOTIONS

From time to time, Amichi Co may offer discounts, promotions, and special codes to enhance your shopping experience. By using these discounts or promotional codes, you agree to the following terms:

General Terms: Discounts and promotions are subject to specific terms and conditions provided at the time of promotion, and each offer may vary. Amichi Co reserves the right to modify or withdraw any promotional offer at its discretion and without prior notice.
One-Time Use: Unless otherwise specified, discount codes are valid for single use per customer and are non-transferable.
Expiry: Some promotional codes and discounts have an expiry date, which will be shown with the offer. Codes cannot be used after their expiry date.
Non-Transferable: Discounts and promotional codes are non-transferable and cannot be exchanged for cash.
Limitations on Use: Some discounts may be restricted to specific products, collections, or minimum order amounts, or may exclude certain items such as custom or sale items. The specific terms will be indicated with each promotion.
Change-of-mind returns: Items purchased during a sale event, with a limited-time promotional code or through the print set offer cannot be returned for a change of mind. Australian orders using the Amichi Circle welcome offer remain eligible for change-of-mind store credit, as set out in our Refund Policy. This does not affect your rights if an item is faulty, damaged or not as described.
Combining Discounts: Only one discount code or promotion may be applied per order. Discounts cannot be combined with other discounts, offers, or special promotions unless explicitly stated.
Order Adjustments: Once an order with a discount or promotional code is placed, codes cannot be applied retroactively or adjusted on an existing order. Any changes or cancellations to orders with discounts may forfeit the discount.
Limitations and Abuse: Amichi Co reserves the right to cancel or refuse any orders using a discount or promotional code if misuse, fraud, or a violation of the terms is suspected. Abuse of discounts or promotional codes may result in order cancellation and restriction from future use.
Assistance: If you have questions or encounter issues with a discount or promotional code, please contact our team at hello@amichico.com before completing your order, as we cannot retroactively apply discounts after an order is placed.
Promotional/Sale Gift Cards: Promotional gift cards (including those purchased at a discounted rate or as part of a special offer) cannot be redeemed toward purchases made during the same promotional or sale period. Customers may not combine the use of promotional gift cards with any other active promotion or discount running at the time of redemption. Promotional gift cards can only be used once the promotional period during which they were purchased has ended. There is also a limit of two per customer.
